Call Kudu — Trial Terms of Use

These terms govern free trial access to Call Kudu. By using the service you agree to them.

1. Acceptable Use

You may only use Call Kudu for lawful business purposes. You must not:

  • Use the service for fraud, scams, impersonation, harassment, or deceptive activity.
  • Use it for illegal marketing, spam, robocalling, or unlawful data collection.
  • Use it to facilitate criminal, harmful, or prohibited conduct.

2. Your Responsibility

You are solely responsible for all calls, messages, and content sent through your account, including actions taken by your team members and any automated configurations.

3. Call Recording & Transcription

Calls handled through Call Kudu are transcribed for service functionality and quality improvement. Calls may also be recorded depending on your configuration.

When we process calls and caller personal data on your behalf, we act as Data Processor and you are the Data Controller. You are responsible for:

  • Identifying the lawful basis for calls being answered, recorded, and transcribed by an AI.
  • Obtaining any caller consents required under UK GDPR, PECR, or other applicable law.
  • Configuring the service appropriately for your business before going live.

4. AI Limitations

Call Kudu uses artificial intelligence, including large language models and synthesised voice, to handle calls. You acknowledge that:

  • AI-generated responses, transcripts, summaries, and messages may be inaccurate, incomplete, misunderstood, or otherwise unsuitable.
  • AI can make mistakes. It may misinterpret caller intent, produce incorrect information, or respond in unexpected ways.
  • You are solely responsible for verifying any AI output before acting on it. Do not rely on AI-generated content for important business, legal, financial, or operational decisions without independent verification.

We are not liable for any loss, damage, or consequence arising from your reliance on AI-generated output.

5. Limitation of Liability

The service is provided “as is” for trial purposes with no guarantees of uptime, accuracy, or fitness for purpose. To the maximum extent permitted by law, our total liability to you shall not exceed £100. Nothing in these terms limits our liability for death or personal injury caused by negligence, fraud, or any liability that cannot lawfully be excluded under the laws of England and Wales.

6. Indemnity

You agree to indemnify and hold Call Kudu harmless against claims, losses, liabilities, and costs arising from your unlawful or prohibited use of the platform, including any failure to obtain required caller consents or comply with applicable call-recording laws.

7. Suspension & Termination

We may suspend or terminate trial access at any time, with or without notice, where misuse, abuse, or unlawful behaviour is suspected, or for any other operational reason.

8. Governing Law

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
